On 6 June 2013 the Court of Appeal of England and Wales ruled that the sale of nail care products in the United Kingdom under the name LUMOS by Sweet Squared Limited, Famous Names LLC and Sweet Squared (UK) LLP, passed off such products as being products of or associated with Lumos Skincare Limited, and the Court of the Appeal granted an injunction against the sale of such LUMOS nail care products. Sweet Squared successfully defended the claim at a trial in the Patents County Court following an appeal by the Claimant the Court of Appeal issued the above judgment. Sweet Squared are now currently seeking leave to appeal to the Supreme Court in order to overturn the Court of Appeal's decision and restore the original trial decision, on several grounds including about European Union law.
